1This Application was scheduled for a 2-day hearing commencing February 24, 2015. The Tribunal issued a Notice of Hearing on October 29, 2014 following an adjournment of the original hearing dates in September, 2014. The Tribunal consulted with the parties and received confirmation of their availability prior to scheduling the hearing to commence on February 24, 2015.
2The hearing commenced as scheduled at 9:30 a.m. Counsel for the respondents was in attendance, the applicant and his counsel were not. I waited 30 minutes for the applicant to appear which is consistent with the Tribunal’s practice in these circumstances.
3The Tribunal has not received any indication that the applicant did not receive the Notice of Summary Hearing. I am satisfied that the applicant has abandoned the Application.
4Accordingly, the Application is dismissed as abandoned.
