DECISION
Adjudicator: Jo-Anne Pickel
Indexed as: Burt v. Ontario (Community and Social Services)
1The complaint alleged discrimination because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), in the special diet allowance provided under Ontario’s social assistance system.
2By letter dated October 30, 2014, the Ontario Human Rights Commission advised the Tribunal that it would no longer be assisting the complainant with respect to the following unresolved conditions listed in her complaint: diabetes, extreme obesity, hypercholoestorolemia and hyperlipidemia.
3By Case Assessment Direction (“CAD”), the Tribunal advised the complainant that if she wished to pursue her complaint with respect to these conditions herself, she had to advise the Tribunal in writing with a copy to the respondent by January 31, 2015. In the CAD, the Tribunal advised the complainant that if she did not respond to the CAD by January 31, 2015, her complaint in regards to her remaining unresolved conditions would be dismissed as abandoned.
4The complainant has not filed any materials nor communicated with the Tribunal in any manner following the issuance of the CAD.
ORDER
5The remaining claims in the complaint – that is, those with respect to diabetes, extreme obesity, hypercholoestorolemia and hyperlipidemia – are dismissed as abandoned.
Dated at Toronto, this 24th day of February, 2015.
