1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on December 4, 2014.
2On January 14, 2015, the Tribunal delivered to the applicant the Responses to his Application filed by the respondent. In its Responses, the respondent sought the early dismissal of the Application because the issues in dispute are within exclusive federal jurisdiction. The applicant was directed to deliver and file a Response (Form 11) to the respondent’s request not later than January 28, 2015. The applicant was further advised that if he did not provide written submissions by the required time, the Tribunal may make its decision based only on the information in the Application or may consider the failure to respond as an abandonment of the Application and dismiss it for that reason.
3The applicant did not respond to the Tribunal’s Direction and the time for doing so has passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
