1The hearing of this case is scheduled to begin on February 3 and 4, 2016. The respondent has filed a Request for Order During Proceeding ("Request") seeking the production of records related to the applicant's prior work experience. The applicant opposes the Request.
2The Request is granted in part.
3The question of whether or not the applicant had prior experience in the type of work he was engaged in with the respondent appears to be arguably relevant to the ultimate question in this case being the reasons for the applicant's dismissal from employment. I do note, contrary to the applicant's submission in response to the Request, that the applicant does assert in his reply that he has "25 years of experience in sales (wholesale and retail)." This same assertion is made in the applicant's witness statement. The applicant has made his prior experience an issue in the case and the respondent is entitled to explore this issue in its questioning of the applicant. Having made this ruling I also find that the issue of the applicant's prior experience is largely collateral to the central issues in the case and the Tribunal will likely limit the evidence it will entertain about it.
ORDER
4The applicant will deliver and file a resume of his prior experience in sales (retail and wholesale) with contact information for each period of employment. This Order to be complied with forthwith and in any case prior to January 8, 2016.
5I am not seized of this case.
