1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to goods and services because of disability. This case is scheduled for a one day hearing on January 14, 2016.

2On December 16, 2015, the applicant requested a six month adjournment of this case citing medical issues preventing him from participating effectively in this hearing at this time. The applicant provided a short letter from a physician which provided some support for the applicant’s assertion.

3On the same date the respondent indicated that they did not oppose the request.

4The request is granted. Although the medical evidence provided is not substantial it has not been questioned by the respondent and there appears to be some basis for the request. Moreover the medical information provided does describe an exceptional circumstances related to the conduct of the hearing and as such the request is not inconsistent with the Tribunal’s approach to adjournments.

5The applicant indicates that he will be able to participate in the hearing beginning in June, 2016. The Registrar will schedule a one day hearing of this case on the first available date in June 2016.

DIRECTION

a. The January 11, 2016 hearing date is cancelled.

b. The Registrar will schedule the one day hearing of this case on the first available date in June 2016.
