City of Toronto and Karen Campbell Respondents
DECISION
Adjudicator: David Muir Date: December 22, 2015 Citation: 2015 HRTO 1720 Indexed as: Lessey v. City of Toronto
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On December 19, 2014 the Tribunal deferred this Application without objection pending the resolution of another legal proceeding.
3On November 13, 2015 the Tribunal wrote to the parties. The applicant was asked to inform the Registrar in writing within 30 days of the date of the letter regarding whether the other proceedings remained ongoing and, if possible, to indicate when they were expected to be completed. The letter cautioned the applicant that failure to provide the requested information may result in the Tribunal dismissing the Application as abandoned.
4No party has responded to the Tribunal’s October 30, 2015 letter. The Tribunal’s letter was sent by regular mail and was not returned. There is no indication that it has not been received by the applicant.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
Dated at Toronto this 22nd day of December, 2015.
