2On December 2, 2015, the Tribunal issued a Case Assessment Direction because the Tribunal had not received communication from the applicant in regard to the scheduled hearing, although the applicant had copied the Tribunal on emails sent to the respondent about ongoing issues.
3The December 2, 2015 Case Assessment Direction stated:
If the applicant does not confirm that he will appear at the hearing by December 11, 2015, the Application may be dismissed as abandoned.
4The Tribunal has not received any communication from the applicant since the December 2, 2015 Case Assessment Direction was issued. The applicant has not confirmed that he intends to participate in the scheduled hearing. In these circumstances, the Application is dismissed on the basis that the applicant is deemed to have abandoned the Application.
Decision
5The Application is dismissed as abandoned. The hearing scheduled for January 4, 2016 is canceled.
