1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on May 12, 2015 and the respondent filed a Response on July 20, 2015. Both parties indicated that they agreed to attend mediation.

2The applicant was not available on the date the mediation was originally scheduled. On November 9, 2015, the Tribunal sent the applicant an email requesting that he provide his available dates to reschedule the mediation by November 16, 2015. The applicant did not contact the Tribunal by November 16, 2015.

3By correspondence dated November 20, 2015, the Tribunal advised the applicant that if he did not respond within 10 days of the date of the correspondence, the Tribunal may deem the Application abandoned and close the file. The applicant has not responded to the Tribunal’s correspondence.

4In the circumstances, the applicant is deemed to have abandoned the Application.

5The Application is dismissed.
