1This Application alleges discrimination contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2This case is currently in the queue for mediation.
3A dispute has arisen with respect to the delivery of a document to the applicant by the respondent related to a third party. The respondent filed a Request for Order directing that all hard copies of the document sent to the applicant containing the personal information of R.B. be delivered to the Tribunal and that all digital copies of the documents be destroyed.
4The applicant opposes the Request because she is concerned that the document may disappear and the document may be important to her case. However the applicant is agreeable to delivering the document to the Tribunal to be held in its file pending the conclusion of the proceeding. It is not clear whether this document(s) is an original or a copy.
5In light of the parties agreement on the appropriate solution - that the document(s) in question can be delivered to the Tribunal - the Tribunal makes the following Directions;
a. The applicant will file the document(s) in question with the Tribunal with a copy sent to the respondent to confirm its filing;
b. The applicant will destroy any digital or other copies of the document(s) she may have made.
6The parties are reminded of the Tribunal's Rule 3.3:
3.3 Parties and their representatives may not use documents obtained under these Rules for any purpose other than in the proceeding before the Tribunal.
