1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, on August 8, 2014.
2On August 28, 2015, the Tribunal sent an email to the parties requesting that they provide mutually agreeable dates to reschedule a previously scheduled hearing. The applicant did not respond to this request, but did send in a Request for an Order During Proceedings asking, among other things, to defer this Application pending the conclusion of another proceeding before this Tribunal involving a set of consolidated Applications.
3The Tribunal sent a Case Assessment Direction to the parties on November 3, 2015 advising them that the other proceeding was dismissed as an abuse of process (see 2015 HRTO 1410) and, in any event, there was no reason to address these Applications sequentially. The applicant was directed to provide his availability for hearing dates in March and April 2016, as well as an assurance that he was prepared to attend a hearing on the dates on which he indicated he was available.
4The applicant was informed that if he did not advise the Tribunal of his intentions by November 24, 2015 the Application could be dismissed as abandoned.
5To date, the applicant has not responded to the Tribunal’s direction in the Case Assessment Direction or otherwise communicated with the Tribunal about this Application since the Case Assessment Direction was released. In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
