This Interim Decision addresses the applicant’s request to amend her Application. In her Application, the applicant alleged discrimination in employment because of disability contrary to the Human Rights Code, R.S.O. 1990 c. H. 19, as amended (the “Code”).
By Request for Order During Proceedings (“RFOP”) filed July 7, 2015, the applicant sought to amend her Application to add a number of allegations regarding events that occurred between March 13, 2015 and June 12, 2015. Despite not filing a response the applicant’s RFOP, the respondent appears to have consented to the request to amend as it responded to the additional allegations contained in the RFOP when it filed its Response.

In the circumstances set out above, the Tribunal grants the applicant’s request to amend her Application to add the allegations contained in her July 7, 2015 RFOP.
The Tribunal scheduled a mediation in this matter to take place October 19, 2015. The Tribunal cancelled the mediation at the parties’ request. Therefore, the next step in this matter will be for the Tribunal to schedule a two day hearing.
I note that, at the time that the mediation was cancelled, the respondent’s counsel advised the Tribunal that the parties will be meeting to have direct discussions December 3, 2015. The parties should note that, if they reach a settlement of this Application, they must immediately file a Form 25 with the Tribunal.
Dated at Toronto, this 30th day of November, 2015.
