Introduction

1This Application alleges discrimination with respect to housing because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).

2The hearing of this case is scheduled to begin on April 10, 2015.

3On January 2, 2015 the Applicant filed a Request for Order During Proceeding (“Request”) seeking an Order directing the respondent to produce a number of documents as follows:

a. All internal communication pertaining to his transfer request;

b. Any communication referring to Alan Ricketts;

c. All internal communication pertaining to marihuana.

4The applicant states that these “documents would substantiate my allegations of discrimination.”

5The respondent opposes the Request because it argues the applicant has provided no basis to believe that there are arguably relevant documents which have not been produced. Despite that position the respondent produced further material to the applicant on January 15 and 16, 2015.

6The Request is denied. The applicant’s request is overbroad and non-specific. He articulates no reason to think that there are documents in the respondent’s possession which may be relevant. The Request amounts to a fishing expedition.
