1A hearing in respect of this Application, filed under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, is scheduled for November 9 and 10, 2015 in Toronto.

2By Case Assessment Direction dated November 4, 2015, the Tribunal alerted the applicant to the fact that he had failed to comply with Rules 16 and 17 of the Human Rights Tribunal of Ontario’s (the Tribunal’s) Rules of Procedure regarding pre-hearing disclosure of documents and witnesses and issued directions regarding the same. In particular, the Tribunal directed:

7By no later than 12:00 Noon on November 6, 2015, the applicant shall:

• Deliver to the respondent a copy of his arguably relevant documents; and

• Deliver to the respondent and file with the Tribunal: (1) confirmation of delivery of his arguably relevant documents to the respondent; (2) a list and copy of the documents he intends to rely upon at the hearing; (3) a list of his witnesses; and (4) a brief statement describing what his witnesses will say when they testify.

8The applicant is reminded that he must also submit a witness statement for himself, assuming he intends to testify at the hearing. However, if the applicant only intends to testify about the facts already contained in his Application and Reply, it is sufficient for him to confirm this in writing by 12:00 Noon on November 6, 2015.

9If the applicant has not complied with these directions by 12:00 Noon on November 6, 2015, or communicated with the Tribunal at all, the Application may be dismissed as abandoned.

3The Tribunal also issued directions regarding a production request filed by the respondent. In particular, the Tribunal required that the applicant either comply with the request or advise of his opposition to the request by 12:00 Noon, on November 6, 2015.

4The Case Assessment Direction was delivered to the applicant by email at the email address provided by the applicant in the Application.

5The applicant has not complied with any of the directions given nor has the applicant communicated with the Tribunal in any other way.

6Following the deadline given on November 6, 2015, the respondents have written to the Tribunal asking that the Application be dismissed as abandoned.

7Based on the following, it would appear that the applicant has abandoned the Application.

8The Application is dismissed. The hearing dates of November 9 and 10, 2015 are cancelled.
