1The applicant filed an Application against the Ottawa Police Service. On October 10, 2015, the Tribunal issued to the applicant a Notice of Intent to Dismiss the Application, on the basis that it did not appear that the subject-matter of the Application was within the jurisdiction of the Tribunal. The applicant filed submissions in support that the Application was within the Tribunal’s jurisdiction.
2The Application alleges reprisal in services contrary to the Code. The applicant explained that in 2010, he was involved in a legal dispute with his former employer and he initiated a claim at Small Claims Court which was resolved by way of settlement. He alleges that he was visited by an officer from the Ottawa Police in 2011, who told him to stay away from his former co-workers.
3He believes that he has been under surveillance for a number of years and that the Gatineau Police has not adequately responded to his concerns. Because of these issues he has moved to London Ontario where he believes that the London Police is subjecting him to the same type of behaviour. He believes that the respondent has interfered with his ability to continue to be employed with other employers.
4In response to the NOID, the applicant takes the position that the Charter protects his “droits juridique” and that he has the right to know the charge against him.
5Having considered this matter, I am of the view that it is plain and obvious that the Application does not fall within the jurisdiction of the Tribunal.
6First, in order for the applicant to successfully establish a reprisal he must be able to indicate when he asserted his rights under the Code. In this case, though it is clear that the applicant filed a Statement of Claim, he has not established that he sought an enforcement of his rights under the Code. Secondly, the Statement of Claim was filed against a third party, his former employer, and it is through pure speculation that the applicant links this third party with the respondent.
7In these circumstances, I am satisfied that the Application should be dismissed.
