DECISION
Adjudicator: Laurie Letheren Date: November 3, 2015 Citation: 2015 HRTO 1469 Indexed as: Labrador v. Romagnano
WRITTEN SUBMISSIONS
Arlene Labrador, Applicant Jamie McGinnis, Counsel
Nicola Ramagnano, Respondent Paul Heath, Counsel
Introduction
1This Application alleges discrimination with respect to housing because of race, colour, ancestry, and sex contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On August 4, 2015 the Tribunal delivered the Response and Notice of Intent to Dismiss the Application (“NOID”) to applicant’s counsel. The Tribunal issued the NOID because the respondent had requested that the Application be dismissed on the basis that the applicant had signed a full and final release with respect to the same issues that were outlined in the Application. The applicant was directed to respond to the issues raised in the NOID by no later than August 18, 2015. The NOID advised the applicant that failure to respond to the NOID may be considered an abandonment of the Application and it might be dismissed for that reason.
3To date, the applicant has not responded to the NOID or filed a Reply.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
Dated at Toronto, this 3rd day of November, 2015.
