1This Application alleges discrimination with respect to employment contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2After hearing the applicant’s evidence, I requested that the parties provide submissions on whether the Application has a reasonable prospect of success as discussed in the Tribunal’s decision in Pellerin v. Conseil scolaire de district catholique Centre-Sud, 2011 HRTO 1777.
3In the circumstances of this case it would not be appropriate to provide reasons other than to say that the issues raised by the applicant may only be resolved after hearing the respondent’s evidence. The hearing will therefore continue.
4My conclusion at this stage that the hearing shall continue does not of course mean that the application will be successful but that additional evidence will need to be heard.
5The hearing will continue. The Registrar shall schedule five consecutive hearing days in Toronto for the resumption of the hearing.
