DECISION
Adjudicator: Naomi Overend
Date: October 22, 2015
Citation: 2015 HRTO 1413
Indexed as: Labranche v. Simcoe Condominium Corporation No. 89
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on December 29, 2014, which was deferred on consent pending the conclusion of a civil proceeding with respect to the dispute.
2On September 18, 2015, the Tribunal issued a Case Assessment Direction (“CAD”) directing the applicant to provide submissions on the respondents’ request to reactivate the Application and dismiss it pursuant to s. 45.1 of the Code.
3The applicant was directed to file her submissions no later than seven days from the date of the CAD and was warned that if the applicant failed to file written submissions by the required deadline, the Tribunal might consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason.
4The applicant has not responded to the CAD and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 22nd day of October, 2015.
