1This matter is scheduled for a hearing on merits on March 9 and 10, 2016, in Toronto. This Interim Decision addresses a Request for an Order During Proceeding filed by the respondent seeking to correct its business name and removing two of its employees as individual respondents.
2The applicant has not responded to this Request and the time for doing so has long passed. This Request is therefore unopposed.
3Having considered the Request and the factors identified in the often quoted case of Persaud v. Toronto District School Board, 2008 HRTO 31, I am satisfied that the individual respondents should be removed as parties to the Application. I also note that the request is unopposed and that the applicant has not made any submissions in support of maintaining these two employees as respondents to the Application.
Order
4The Tribunal orders the following:
a. The respondent`s Request is granted;
b. The individual employees’ shall be removed as respondents to the Application;
c. The respondent`s legal business name shall be corrected; and
d. The style of cause shall be immediately amended to reflect these changes.
