APPEARANCES
Noah Kirshenbaum, Applicant No one appearing
Phoenix Enterprises Ltd. o/a Globe General Agencies, Respondent David Lyman, Counsel
1These are two Applications arising out of the applicant’s tenancy with the respondent. The Tribunal scheduled a summary hearing by telephone conference call. The hearing was scheduled on October 2, 2015. The respondent appeared on the call. The applicant did not appear although he was given half an hour to do so in accordance with the Tribunal’s usual practice.
2The Notice of Summary Hearing was delivered to the applicant at the address he provided to the Tribunal and there is no indication that it was not received by the applicant.
3The Tribunal’s usual practice when an applicant fails to appear for a hearing, and when there is no apparent reason for the failure to attend, is to dismiss the Application as abandoned. In this case, the applicant failed to attend the hearing and there is no apparent reason for his failure to attend. For these reasons, the Application is dismissed as abandoned.
Dated at Toronto, this 6th day of October, 2015.
