1This Decision arises from an Application filed December 17, 2013. The applicant alleges that he experienced discrimination with respect to his employment because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2Mr. Hannah (the “applicant”) was employed as a chef with Capital City Smokehouse and Restaurant (the “organizational respondent”) which is co-owned by John Doherty and Doug Fitzgerald (the “individual respondents”).
3The respondents were notified of the Application on August 11, 2014 indicating that an Application had been filed against both the organizational and individual respondents. In the Response which was filed on November 12, 2014, the respondent, Mr. Doherty, indicated that he would act as agent for the organizational respondent. The Response does not indicate that it is being filed on behalf of either Mr. Doherty or Mr. Fitzgerald; however, the narrative of the Response makes reference to the role of both individuals in the events leading to the applicant’s hiring and termination.
4The Confirmation of Hearing was sent to the address provided by Mr. Doherty in the Response and was not returned to the Tribunal.
5The respondents did not attend the hearing nor have they made contact with the Tribunal to explain their failure to attend.
