1The applicant filed an Application under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”) on July 31, 2014.
2The Tribunal deferred the Application pending conclusion of the grievance process by letter dated October 6, 2014, upon the respondent’s request. Neither the applicant nor the intervenor filed submissions in relation to the deferral request.
3On July 20, 2015, the Tribunal wrote to the parties and requested that the applicant provide an update about the status of the grievance proceeding. It warned the applicant that if he failed to respond, his Application may be dismissed as abandoned. The applicant did not respond to this letter.
4The Tribunal sent another letter, dated September 14, 2015, requesting the applicant to provide an update. It set a deadline of September 28, 2015 and again warned the applicant that his Application may be dismissed as abandoned. This letter was sent by regular mail, courier and email. The applicant did not respond to this letter, and has not communicated with the Tribunal since he filed his Application.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
