1This Application was filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on February 17, 2015. The respondents filed Responses to the Application on June 1 and 2, 2015.
2On July 22, 2015, the Tribunal issued a Case Assessment Direction (“CAD”), directing the applicant to deliver and file a Reply (Form 3), or a Form 10, responding to the issues raised by the respondents in their Responses, within 7 days of the date of the CAD. The Tribunal indicated that if the applicant failed to deliver and file a Reply or Form 10 within 7 days of the date of the CAD, the Application may be dismissed as abandoned. The CAD was sent to the applicant by both regular mail and email at addresses the applicant provided to the Tribunal.
3On July 30, 2015, the applicant wrote to the Tribunal by email seeking an extension of time. The Tribunal responded to the applicant by email asking him to indicate how long of an extension he required. While the Tribunal did not hear back from the applicant, by email correspondence dated August 6, 2015, the Tribunal granted the applicant an extension of time until August 20, 2015 to file submissions in response to the Tribunal’s July 22, 2015 CAD. The Tribunal also indicated that all requirements of the CAD remain as stated.
4To date, the applicant has not provided submissions in response to the Tribunal’s July 22, 2015 CAD, nor does it appear that he has otherwise communicated with the Tribunal since requesting an extension of time on July 30, 2015. The Tribunal’s CAD and email correspondence to the applicant referred to above have not been returned as undeliverable.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
