RECONSIDERATION DECISION
Adjudicator: Jo-Anne Pickel
Indexed as: Smith v. Child and Adolescent Mental Health Care
WRITTEN SUBMISSIONS
Larena Smith, Applicant
Self-represented
1The applicant has filed a second Request for Reconsideration of my Decision, 2015 HRTO 886, dated July 3, 2015, dismissing her Application. The applicant filed a first timely Request for Reconsideration on July 27, 2015. This Request was denied with reasons in 2015 HRTO 1129.
2The applicant filed a second Request for Reconsideration on September 14, 2015. This second Request was filed after the 30 day deadline for filing a Request for Reconsideration, set out in Rule 26.1 of the Tribunal’s Rules of Procedure (“Rules”). Therefore, the Request is denied as untimely.
3In addition, Rule 26.7.1 of the Rules provides as follows:
26.7.1 Where a Request for Reconsideration has been determined, the Tribunal will not consider a subsequent Request for Reconsideration of the same decision, absent exceptional circumstances. The Tribunal need not give reasons for a decision not to consider a subsequent Request.
4There are no exceptional circumstances identified by the applicant in her second Request. In her second Request, she continues to make the same types of allegations as she has made all along in this proceeding. Accordingly, the Request is also dismissed under Rule 26.7.1.
ORDER
5For the above reasons, the applicant’s second Request for Reconsideration is denied.
Dated at Toronto, this 22nd day of September, 2015.
