1This is an Application filed under section 45.9(3) of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The respondents filed a Response to the Application asserting that the Application should be dismissed because the dispute was not within the Tribunal’s jurisdiction to decide.
3On March 31, 2015, the Response was delivered to the application with a Direction that the applicant provides written submissions in response to the issue raised by the respondents.
4On April 15, 2015, the applicant sent an email to the Tribunal together with a Form 11. In the applicant’s email he stated: “I wish to dismiss my claim file # 2014-19244-I.
5There was no indication that the applicant had delivered this material to the other parties. Accordingly on April 28, 2015, the Tribunal directed that the applicant confirm that he had delivered this material to the other parties. The applicant did not respond to this direction and the time for doing so passed.
6On June 17, 2015, the Tribunal wrote to the applicant reminding of the communications above and directed the applicant to confirm his intentions with respect to the Application by June 26, 2015, failing which it may be dismissed as abandoned.
7The applicant has not responded to these Directions and the time for doing so passed.
8In all of the circumstances, I find that the applicant has abandoned this Application and it is dismissed.
