1This Application was filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on September 17, 2012.
2By Interim Decision, 2015 HRTO 1038, dated August 5, 2015, the Tribunal confirmed that the Application against the respondent is stayed under s. 69 of the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3. The applicant was directed to advise the Tribunal in writing, within 14 days of the date of the Interim Decision, whether she intended to seek the Receiver’s consent or an order of the Court to have the stay lifted. The Tribunal indicated that if the applicant failed to advise the Tribunal of her intentions within the 14 day time period, the Tribunal would deem the Application against the respondent abandoned.
3To date, the applicant has not advised the Tribunal of her intentions as directed, and the time period for doing so set out in the Tribunal’s August 5, 2015 Interim Decision has passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
