1A hearing in respect of this Application is scheduled for August 27, 2015 in Toronto.
2On August 20, 2015 the respondent, Marca College Hair and Esthetics (the “respondent”), requested an adjournment of this hearing on the basis that its relationship with its lawyer ended that day and it was in the process of retaining new counsel. This request was denied. Subsequently, newly retained counsel for the respondent advised that the respondent’s previous representative had unexpectedly terminated the retainer, leaving the respondent without representation one week before the hearing.
3On the basis of this new information, the Tribunal sought submissions from the applicant. The applicant does not oppose the adjournment, but states that it should be peremptory on the respondent as this is the second time the respondent has requested a last-minute adjournment. Since the first adjournment request was due to the illness, the Tribunal has no information concerning the respondent’s conduct which would make a peremptory order appropriate.
4Accordingly, the hearing for August 27, 2015 is adjourned. The Registrar will contact the parties to reschedule a date for this hearing. As stated earlier, it is not necessary for Dufferin Mall to attend the rescheduled hearing.
