1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to the provision of goods and services because of sex, sexual orientation and marital status.
2In their Response (Form 2), the respondents sought the early dismissal of the Application because they argue the dispute has been settled with a full and final release being signed by the applicant.
3The Response was delivered to the applicant’s representative on March 13, 2015, who advised on January 29, 2015, that he no longer represented the applicant.
4On May 5, 2015, the Tribunal delivered the Response directly to the applicant. The Tribunal directed the applicant to deliver her Reply to the Response by May 19, 2015.
5The applicant did not respond to the Tribunal’s correspondence of May 5, 2015, and had not communicated with the Tribunal in any way for some time. By Case Assessment Direction dated June 1, 2015, the Tribunal directed the applicant to file a Reply to the Response addressing the request to dismiss the Application within 14 days of the date of the Case Assessment Direction. As of the date of this Decision, the applicant has not filed a Reply or communicated with the Tribunal.
6In these circumstances, it appears the applicant has abandoned the Application. The Application is dismissed.
