Between:
Kiet Truong Applicant
-and-
Tobias House Attendant Care Inc. Respondent
Decision
Adjudicator: Geneviève Debané Date: August 20, 2015 Citation: 2015 HRTO 1108 Indexed as: Truong v. Tobias House Attendant Care Inc.
1On April 27, 2015, the applicant filed this Application alleging discrimination with respect to employment contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”) but did not identify any grounds of discrimination.
2On April 27, 2015, the Tribunal sent the applicant a Notice of Incomplete Application because he had failed to identify any grounds of discrimination. In response the applicant wrote in to advise that he was reprised against specifically because he was a member of a bargaining committee to renegotiate the collective agreement between the respondent and his union.
3On July 6, 2015, the Tribunal sent a Notice of Intent to Dismiss seeking submissions from the applicant with respect to whether the Application was within the jurisdiction of the Tribunal. The applicant was advised that if he did not file submissions as directed that the Tribunal may dismiss the Application as abandoned.
4The applicant has not filed any submissions and the time for doing so has passed.
5In these circumstances, I find that the applicant has abandoned the Application.
6The Application is dismissed.
Dated at Toronto, this 20th day of August, 2015.
