1This Application alleges discrimination with respect to employment contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The Tribunal received a Request for an Order During Proceeding seeking the disclosure of video statements in the possession of the Toronto Police. No submissions have been received from the Toronto Police and the time for doing so has passed.
3Having considered the matter I am of the view that the statements sought by the respondent are arguably relevant to the proceedings and pursuant to Rule1(7)(p) I have the power to compel the production of documents held by third parties.
Order
4The Tribunal orders:
a. By August 24, 2015, the Toronto Police Services Board shall send to the respondent’s counsel (the contact information can be found on the cover letter attached to this Interim Decision) copies of the video statements obtained on March 14, 2014 from:
i. Maria Fragkopoulos; ii. Apostolos Fragkopoulos; iii. Walter Derosa; and iv. George Meditskos.
b. Within 3 days of the date of the receipt of these documents the respondent’s counsel shall send a copy to the applicant’s counsel.
