Introduction
1This Application alleges discrimination with respect to employment because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2This Interim Decision addresses the respondent’s request that the Tribunal defer consideration of the Application pending the result of a proceeding at the Workplace Safety and Insurance Board (“WSIB”).
3The applicant filed a Reply and a response to the request to defer. The applicant indicated that the proceeding before the WSIB has been completed as the WSIB has issued a decision in the matter.
4Since the WSIB matter has concluded, it is not appropriate to defer this Application.
ORDER
5For the reasons set out above, the respondent’s deferral request is denied.
6As the parties have agreed to mediation, the next step will be for the Registrar to schedule mediation in this matter.
