INTRODUCTION
1This Interim Decision addresses the applicant’s December 19, 2014 request to reactivate her deferred Application. The respondent filed no Response.
2Rule 14.4 of the Tribunal’s Rules of Procedure states:
Where an Application was deferred pending the outcome of another legal proceeding, a request to proceed under Rule 14.3 must be filed no later than 60 days after the conclusion of the other proceeding, must set out the date the other legal proceeding concluded and include a copy of the decision or order in the other proceeding, if any.
3The applicant filed the Request to reactivate together with a copy of the arbitration decision, dated October 22, 2014, within the 60 days required by the Rule.
4The respondent did not oppose the request to reactivate.
5In the circumstances of this case, the Tribunal orders that the applicant’s Application be reactivated.
6The applicant in the body of her Form 10 Request for an Order During Proceedings requested that the Tribunal assist her in obtaining copies of two investigation reports. I find the request premature as the exchange of documents has not taken place. The applicant can renew this request after the exchange of documents, if necessary.
7I am not seized.
