1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to employment because of race, colour, ancestry, ethnic origin and reprisal. This Interim Decision addresses a Request for an Order During Proceedings (the “Request”) filed by the applicant.
2In a Case Assessment Direction (CAD) issued on April 8, 2014, the Tribunal directed, on its own initiative, that a summary hearing be held to determine whether the Application should be dismissed, in whole or in part, because the Application had no reasonable prospect of success. The Tribunal scheduled the summary hearing on July 17, 2014.
3The applicant filed the Request on June 4, 2014 and the respondent Teamsters Union Local 419 (the “union”) filed a Response to a Request for an Order on June 13, 2014. The respondent William Osler Heath System did not file a response and the time for doing so has passed.
4The applicant seeks disclosure of notes of meetings the applicant states she had with personnel of the respondents that dealt with her human rights concerns. Rules 16 & 17 of the Tribunal’s Rules of Procedure provide timelines for disclosure of documentation and witnesses prior to the hearing of the merits of an Application, which does not include a summary hearing. Those timelines do not commence until the Tribunal issues a Notice of Confirmation of Hearing. This matter has not yet been scheduled for a hearing and the Tribunal has not yet issued a Notice of Confirmation of Hearing in this matter. In these circumstances, the applicant’s Request for documents is premature and is dismissed.
