1The hearing in this matter is scheduled for July 21, 22, and 23, 2014. The applicant requests a six-month adjournment because of the death of her father which required her to travel to another country. The respondent opposes the request.
2I have carefully read the submissions filed by the parties. In the circumstances of this case, I will grant an adjournment of the July hearing dates. However, I do not see that an adjournment for a further six months is necessary. Accordingly, the Tribunal will canvass the parties’ availability for three hearing dates commencing in October 2014. These hearing days may not be consecutive.
3The respondent has filed both the documents upon which it intends to rely at the hearing as well as its witness statements. I will leave it up to the parties to determine the issue of whether or not the applicant’s undertaking to return the respondent’s materials to the respondent until the delivery of the applicant’s materials is completed.
4As for the applicant’s documentation and witness statements, she is directed to file those with the Tribunal and provide a copy to the respondent at least 30 days before the first day of hearing. That time frame may be revisited and adjusted based upon the submissions of either party.
5Full reasons for this determination will be provided, at the appropriate time, upon request by a party.
