This Application alleges discrimination with respect to services because of age contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
Because of the nature of the allegations made in this Application and the absence of any apparent connection between the allegations and a ground of discrimination under the Code, the Tribunal directed that a summary hearing would be held by teleconference on June 25, 2014 to determine if there was no reasonable prospect that the Application would succeed.
The parties were provided notice of the summary hearing through a Confirmation of Hearing dated February 7, 2104. The applicant was informed that if she did not participate in the hearing her Application could be declared abandoned.
The applicant did not dial in to the teleconference at the scheduled time of 9:30 on June 25, 2014. As is the practice of the Tribunal, she was given a grace period of an additional 30 minutes, but did not dial in during that time either.
I have no reason to believe that the applicant did not receive notice of the summary hearing or the potential consequence of not participating. As she has not participated in the summary hearing despite having been given notice, her Application is declared abandoned.
