1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of disability.
2This Application was deferred in 2012 HRTO 1645 pending the completion of a proceeding before the WSIAT.
3On May 30, 2014 the applicant has filed a Request for Order During Proceedings (Form 10) seeking to reactivate the Application. The applicant made no submissions but appended a copy of the WSIAT decision which appears to have concluded the other proceeding with the applicant being deemed to have abandoned his appeal. The respondent did not respond to the Request and the time for doing so has passed.
4In the circumstances I find that it is appropriate that the Application is re-activated.
Direction
5The Tribunal's Registrar will schedule a two day hearing in this case. Further Directions from the Tribunal with respect to the hearing will be issued in due course.
6I am not seized of this case.
