1This Application alleges discrimination with respect to employment because of record of offences contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The applicant was removed from his regular shift because of pending criminal charges. The charges were dismissed against the applicant. No conviction resulted from these charges.
3The Code prohibits discrimination on the basis of record of offences in situations where an applicant has been convicted of certain offences. The Tribunal sent the applicant a Notice of Intent to Dismiss his Application because the allegations in his Application do not appear to relate to discrimination on the basis of a conviction for an offence in respect of which a pardon has been granted under the Criminal Records Act (Canada) and has not been revoked, or an offence in respect of any provincial enactment.
4The applicant was directed to make submissions by June 2, 2014 on why his Application should proceed in relation to circumstances which appear to be beyond the scope of the Code and therefore outside the jurisdiction of the Tribunal. He has not made any submissions and the time for doing so has now passed.
5As the applicant has failed to respond to the Tribunal’s direction I determine that he has abandoned his Application.
