Introduction
1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination with respect to contract because of family and marital status. The Application has not yet been delivered to the respondent.
2On November 27, 2013, the Tribunal issued a Notice of Intent to Dismiss (“NOID”) on the basis that the Application does not fall within the jurisdiction of the Tribunal on the basis that the parties are former spouses and the narrative does not disclose any acts of discrimination within the meaning of the Code.
3On January 10, 2014 the applicant filed submissions with respect to the NOID.
DECISION
4The applicant alleges that he and the respondent are spouses who have been separated since May 1995. The applicant asserts that he has been treated unfairly by his spouse during subsequent legal proceedings.
5Having considered the matter I find that it is plain and obvious that the Application is not within the jurisdiction of the Tribunal because the Code does not govern private relationships between parties, including marriage. See: Belso v. York Regional Police, 2009 HRTO 757. Further, the Application and subsequent submissions filed by the applicant fail to identify any specific acts of discrimination within the meaning of the Code.
6The Application is dismissed.
