HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Michael Moore
Applicant
-and-
Amway Canada Corporation
Respondent
DECISION
Adjudicator: Brian Cook
Indexed as: Moore v. Amway Canada Corporation
1This Application alleges discrimination because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). The Application indicates that the applicant asked the respondent for accommodation of a disability and was denied. The Application does not indicate what the requested accommodation was. The Application indicates that the applicant expected the respondent to pay him a very large signing bonus and a very large guaranteed monthly income.
2After reviewing the Application, the Tribunal Registrar wrote to the applicant advising that a review of the Application did not identify any specific acts of discrimination within the meaning of the Code on the part of the respondent. The applicant was asked to send further information in writing to the Tribunal to clarify the Application.
3The applicant sent a letter stating that he does not agree that the Code does not apply to his complaints about the respondent. However, he did not clarify what his allegations are or identify any specific alleged act of discrimination.
4The Tribunal sent the applicant a Case Assessment Direction dated April 25, 2014. It read in part as follows:
If the applicant wishes to pursue this matter, he should provide as much information as possible about his complaints. He must set out the following information in writing to the Tribunal:
What exactly happened;
Who was involved;
When did it happen; and
Where did it happen?
5The applicant sent a letter to the Tribunal on May 3, 2014. This letter essentially restates what was said in the Application. It indicates that the respondent denied the applicant guaranteed sales and that the respondent told him that there were no guaranteed sales. The letter does not provide or identify any specific act of alleged discrimination.
6On the basis of the information provided by the applicant, I cannot identify any alleged discrimination regarding anything that this Tribunal would have the power to deal with.
7On this basis, the Application must be dismissed.
Dated at Toronto, this 28th day of May, 2014.
