1This Application was filed on May 2, 2013, and alleges discrimination with respect to employment because of family status, contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2By Interim Decision dated June 27, 2013, 2013 HRTO 1125, the Tribunal determined that it was appropriate to defer this Application pending completion of related proceedings under the Employment Standards Act, 2000, S.O. 2000, c. 41 (the “ESA”).
3On April 15, 2014, the applicant filed a Request for an Order During Proceedings (“RFOP”) to re-activate the Application. The applicant attached to his RFOP a copy of Reasons for Decision of an Employment Standards Officer, sent to him by the Ministry of Labour under cover of letter dated February 18, 2014. The applicant confirmed that the RFOP was delivered to the respondent.
4To date, it appears that the respondent has not responded to the applicant’s RFOP to re-activate his Application, and the time for doing so has passed.
5In the circumstances, as it appears that the proceedings under the ESA have concluded, the applicant’s RFOP to re-activate his Application is granted.
6As the respondent has not yet been required to file a Response to the Application, the respondent is directed to file a Response (Form 2) to the Application within 35 days of the date of this Interim Decision.
