1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2The Notice of Hearing was sent to the parties on September 13, 2013. In it, the parties were advised that the hearing would commence at 9:30 a.m. on March 24, 2014 at 655 Bay Street, on the 14th Floor, in Toronto. The Notice was sent to then counsel for the applicant at the address provided in the Application and was not returned.
3At the time and place set for the commencement of the hearing, although the respondents were present, along with counsel, the applicant was not. By 10:00 a.m., the applicant had still not arrived.
4There is no indication that the applicant did not receive notification of the date, time and place of the hearing. I am satisfied that the applicant received timely and proper notice of the hearing. In the absence of the applicant and in the absence of any explanation for his failure to attend as required, the Application is dismissed as abandoned.
