1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on February 14, 2014.
2On March 7, 2014 the Tribunal issued a Notice of Intent to Defer the Application (“NOID”) pending the conclusion of another legal proceeding. The applicant did not respond to the NOID and the time for doing so passed.
3On April 7, 2014 the respondents delivered and filed a Request for Order During Proceedings (“Request”) seeking the dismissal of the Application on the basis that it was outside of the Tribunal’s jurisdiction to decide the respondent being a federally regulated enterprise. The applicant did not respondent to this Request.
4On May 1, 2014 The Tribunal wrote to the applicant directing that he provide his submission in response to the respondents’ Request by May 8, 2014 failing which the Application may be dismissed as abandoned.
5The applicant has not responded and the time for doing so has now passed.
6In the circumstances, the applicant is deemed to have abandoned the Application.
7The Application is dismissed.
