1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on October 17, 2014.
2On January 15, 2014 the Tribunal issued a Notice of Intent to Defer the Application (“NOID”) pending the conclusion of another legal proceeding. The applicant did not respond to the NOID and the time for doing so passed.
3On March 3, 2014 the Tribunal issued a Case Assessment Direction directing that the parties provide their submission about whether or not the Application should be dismissed pursuant to section 45.1 of the Code because the substance of the Application was dealt with in the other proceeding. The applicant was directed to respond to this issue By March 27, 2014 failing which the Application May be dismissed as abandoned.
4The applicant has not responded and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
