Decision

1In 2013 HRTO 1276 this Applicatoin was deferred pending the conclusion of a grievance artbitration related to all or some of the issues raised in the Application.

2The applicant filed a Request for Order During Proceeding seeking the reactivation of the Application because the grievance had been withdrawn. The respondent has confirmed that the grievance has been withdrawn although not explicitly consenting to the reactivation of the Application.

3In the circumstances I find that it is appropriate to reactivate the Application. It will proceed to the next step in the Tribunal process.

4A Response to the Application has not been filed to date. The respondent is directed to deliver and file a Response (Form 2) to the Application within 35 days of the date of this Interim Decision.
