HUMAN RIGHTS TRIBUNAL OF ONTARIO
B E T W E E N:
Leah Deffett Applicant
-and-
Canadian Union of Public Employees, Tim Maguire, Nancy Murphy and Ainsworth Hamilton Respondent
DECISION
Adjudicator: Alison Renton Date: May 7, 2014 Citation: 2014 HRTO 671 Indexed as: Deffett v. Canadian Union of Public Employees
1This is an Application filed on December 2, 2013 under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleging discrimination with respect to employment because of reprisal.
2On March 14, 2014, the Tribunal issued a Notice of Intent to Dismiss ("NOID") on the basis that the Application appears to be outside the Tribunal's jurisdiction to decide because the allegations against the respondents did not appear to relate to reprisal, as defined by the Code. The applicant was directed to respond to the issues raised in the NOID by no later than April 14, 2014. The NOID advised the applicant that a failure to respond to the NOID by the required time may be considered an abandonment of the Application and the Application might be dismissed for that reason.
3The applicant has not responded to the NOID and the time for doing so has now passed. The NOID was delivered to the applicant at her address provided in the Application and has not been returned as undeliverable.
4In the circumstances, the applicant is deemed to have abandoned the Application.
Dated at Toronto, this 7th day of May, 2014.
