1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code").
2On February 14, 2014 the respondent filed a Request for Summary Hearing (Form 26) and a Request for Order during Proceeding seeking the dismissal of all or part of the Application on the basis of delay. The applicant did not respond to either Request of the respondent.
3In a Case Assessment Direction issued on March 24, 2014 the applicant was directed to deliver and file a Reply (Form 3) addressing the Request for Summary Hearing and the Request for Order during Proceeding within 7 days of the date of the Direction, failing which this Application may be dismissed as abandoned.
4The applicant did not respond to this Direction or communicate with the Tribunal in any fashion.
5The filing of an Application commences a legal proceeding which engages significant public and private resources. It is the Tribunal's expectation that the parties to an Application will participate in the process. This includes responding to issues as they arise in the course of the proceeding.
6In all of the circumstances the applicant appears to have abandoned this Application and accordingly it is dismissed.
