1This is an Application filed pursuant to section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination in the provision of goods and services because of sex.

2In a Case Assessment Direction issued on November 6, 2013 the The Tribunal of its own initiative directed that a summary hearing be held to determine whether this Application should be dismissed, in whole or in part, on the basis that there is no reasonable prospect that the Application or part of the Application could succeed.

3A Notice of Summary Hearing was issued on December 12, 2013 confirming that the summary hearing would take place on Tuesday April 22, 2014 at 8:30 a.m. by teleconference.

4At the time and place set for the teleconference hearing the applicant was not in attendance. The respondent was. In accordance with the Tribunal’s usual practice I adjourned the summary hearing until 10:00 a.m. or when the applicant attended on the call whichever occurred first.

5At 10:00 a.m. the respondent returned to the call. The applicant was still not in attendance. I was satisfied that the applicant received proper Notice of the summary hearing and chose not to attend. In all of the circumstances the Application was dismissed as abandoned at the summary hearing.
