1This is an Application filed under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). This Interim Decision determines a Request for Order During Proceedings filed March 11, 2014 seeking reactivation of the Application.
2By Interim Decision dated September 13, 2013, the Tribunal ordered the deferral of the Application pending the conclusion of the grievance proceeding: 2013 HRTO 1543. By further Interim Decision dated November 12, 2013, the Tribunal denied a request to reactivate because the grievance was still in process: 2013 HRTO 1883. On March 11, 2014, the applicant filed a further request to reactivate. The applicant states that two conciliation meetings were held but the grievance did not resolve and the union has taken the position that the grievance will not be referred to arbitration. A letter to the applicant from the Toronto Police Association summarizing the status of the grievance including the Association's decision to not proceed to arbitration is attached to the applicant's Request.
3The applicant's cover letter seeking reactivation reflects that a copy was sent to the respondents and the Toronto Police Association. No responses have been filed and the time for doing so has elapsed.
4Having regard to the material filed and the absence of any opposition to the request, the Application is reactivated.
5The Application will now continue to be processed. The respondents are required to file a Response within 35 days of the date of this Interim Decision.
6The Tribunal directs:
- The Request to reactivate the Application is granted; and
- The respondents are required to file a Response to the Application within 35 days of the date of this Interim Decision.
7I am not seized.
