1On January 20, 2014, the Tribunal issued a Notice of Hearing to the parties, which informed them that the hearing was scheduled for July 31 and August 1, 2014. The Notice also informed them that pursuant to Rule 16.1 of the Tribunal’s Rules of Procedure, they were required to deliver to each other a list and copy of all arguably relevant documents in their possession by no later than February 10, 2014.
2The applicant complied with Rule 16.1 in a timely manner, but the respondent did not. On February 28, 2014, the respondent delivered a list and copy of arguably relevant documents in its possession to the applicant’s address by courier. On March 4, 2014, the applicant refused to accept the courier delivery.
3Both parties have filed written submissions requesting that the Tribunal deal with this matter. The applicant has essentially requested that the Tribunal expedite the hearing and refuse to allow the respondent to present documents at the hearing. The respondent has essentially requested that the Tribunal direct the applicant to accept its late delivery of arguably relevant documents.
4In view of the fact that the applicant has not identified any real prejudice to him in receiving the respondent’s arguably relevant documents approximately three weeks late, the Tribunal directs him to accept the respondent’s delivery of those documents. The applicant’s request that the Tribunal expedite the hearing and refuse to allow the respondent to present documents at the hearing is denied.
