DECISION
Adjudicator: Jay Sengupta
Date: March 28, 2014
Citation: 2014 HRTO 447
Indexed as: Humphrey v. CAPREIT
1This is an Application under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, filed on August 20, 2013.
2On November 5, 2013, the Tribunal sent the applicant a Notice of Intent to Dismiss (“NOID”), in which it indicated that upon reviewing the Application, it appeared that the Application may be outside the jurisdiction of the Tribunal because the narrative setting out the incidents of alleged discrimination failed to identify any specific acts of discrimination within the meaning of the Code. The NOID directed the applicant to file written submissions on the issues identified on or before December 5, 2013, failing which the Application might be dismissed as abandoned.
3The deadline for the applicant to file submissions has passed, and the applicant has not filed the required materials with the Tribunal, nor has she communicated with the Tribunal in any way.
4In the circumstances, it appears that the applicant has abandoned the Application. Accordingly, the Application is dismissed as abandoned.
ORDER
5The Application is dismissed as abandoned.
Dated at Toronto, this 28th day of March, 2014.
