1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on September 22, 2012.
2Both parties agreed to mediation which was initially scheduled to take place on March 13, 2014. A Notice of Mediation to that effect was issued on January 14, 2014. On January 30, 2014 the respondent requested that mediation be re-scheduled because they were unavailable on the proposed date.
3On January 30, 2014 the Tribunal wrote to the parties and advised that the re-scheduling request was timely and asked the parties to select amongst a number of possible dates before February 10, 2014. The applicant did not respond to this Direction.
4By correspondence dated February 27, 2014, the Tribunal advised the applicant that if he did not respond by March 10, 2014, the Tribunal would deem the Application abandoned and the close its file. The applicant has not responded to the Tribunal’s correspondence.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
